Monday, the United Nations Special Rapporteur on Torture Manfred Nowak told CNN’s Rick Sanchez that the US has an “obligation” to investigate whether Bush administration officials ordered torture, adding that he believes that there is already enough evidence to prosecute former Secretary of Defense Donald Rumsfeld.

No, Schumer didn’t rule out prosecution, but his support was weak at best:

Echoing Speaker of the House Nancy Pelosi’s words one week ago, New York Sen. Charles Schumer said Sunday that he could support prosecution for Bush officials that participated in torture or broke other laws.

If there are egregious cases, I don’t think you can say, blanket, no prosecutions,” Schumer told Fox’s Chris Wallace Sunday morning. “If there are egregious cases, yes, you have to look at them.” […]

But Schumer was far from aggressive, repeating President Obama’s comment earlier this month that “we should be looking forward, not backward.

You know what looking forward means? It means protecting our own country from future abuses. How? By following the rule of law when our own citizens commit horrendous crimes. And by “our own citizens” I mean the Bush administration, if you can even classify them as real Americans.

At the Progressive Media Summit on Capitol Hill yesterday, Marcy Wheeler asked Sen. Carl Levin (D-MI), the chairman of the Senate Armed Forces Committee, about congressional plans to continue investigating torture. �There needs to be, I believe, an accounting of torture in this country,� replied Levin. He then said that he had suggested to Attorney General-nominee Eric Holder that he appoint �an outside person who�s got real credibility� to continue to investigate:

LEVIN: We�re going to try to complete this investigation, at least on the DoD side, Ok. But on the intelligence, the CIA side, that�s going to be up to the Intelligence Committe. I know I suggested to Eric Holder, who will be the next Attorney General despite the delay that took place today, that he select some people or hire an outside person whose got real credibility, perhaps a retired federal judge, to take all the available information, and there�s reams of it.

In remarks that aired on German television last night, Manfred Nowak, the United Nations Special Rapporteur on Torture, urged the U.S. to pursue former President George W. Bush and defense secretary Donald Rumsfeld on charges that they authorized torture and other harsh interrogation techniques:

�Judicially speaking, the United States has a clear obligation� to bring proceedings against Bush and Rumsfeld. [�] He noted Washington had ratified the UN convention on torture which required �all means, particularly penal law� to be used to bring proceedings against those violating it.

�We have all these documents that are now publicly available that prove that these methods of interrogation were intentionally ordered by Rumsfeld,� against detainees at the US prison facility in Guantanamo Bay, Cuba, Nowak said.

Jonathan Turley has called for justice. Keith Olbermann has. Nancy Pelosi has. We have. The nation is practically begging for it. Bush did not issue pre-emptive pardons, so the door is wide open.

Not to mention, setting a terrible precedent by letting the Bush crime family skate at the expense of our democracy would be a real crime in and of itself.

I have yet to see a complete list of Bush’s crimes. Here are just a few main categories in which Bush has outdone Nero.

    Election Theft

  • Bush’s campaign financed the felonious physical assault of vote re-counters in Florida, even as the State Supreme Court has ruled in favor of Al Gore who had sought the recount, a recount upheld by the Florida Supreme Court. Though, this state issue was resolved legally by the Florida Supreme Court, SCOTUS would later hand down a bogus decision for which there is no precedent or basis in law.
  • Scalia’s rationalization is pure political bunkum and has nothing do with law. Certainly, there was no compelling reason for the US Supreme Court to even hear the case! Scalia said that ‘continuing’ the recount would be harmful to Bush. Duh! In a Democracy the one getting the fewer number of votes is SUPPOSED to lose! Scalia is not only a criminal, he’s an idiot and an arrogant asshole! All his statements concerning Bush v Gore are those of an idiot pretending to be a great intellect.

Bush Goes Rogue

  • In office, Bush imperiously repudiated America’s treaty obligations and international commitments, most notably the Kyoto accords on global warming. An aide to my GOP Congressman told me that the US is not obliged by the treaties it signs!
  • Bush covered up the crime of 911, destroying evidence as he interfered with and obstruction investigations. He opposed the creation of the 911 Commission and interfered with it after its creations. The result: an incomplete, disingenuous, and irrelevant ‘tome’ disowned by the co-chairs of the committee that wasted tax payer dollars coughing it up! Pure propaganda designed to deflect suspicion of the Bush administration complicity and cover up of 911!

Bush Exploits 911

  • Bush presided over and orchestrated an gestalt of lies –much of based on decades old photographs –in order to justify what is, in fact, a war of naked aggression against Iraq for the purpose of ‘liberating’ that nation’s oil resources! His lies about Iraq make the US attack, invasion and continued occupation an on-going war crime in violation of US Codes, Title 18, Section 2441. Bush tried to make these crimes, specifically, legal only after he had already committed them! That’s understandable: the penalty for violating them is death!
  • Bush admits to authorizing a campaign of ongoing tortures at Abu Ghraib and a gulag of Nazi-like hell-holes throughout Eastern Europe. There is evidence that US Troops, under orders from the Bush administration, not only committed various tortures but murder and other atrocities that had been heretofore associated with the likes of the Nazi under Hitler, Pol Pot and August Pinochet.
  • The theft of Iraqi oil resources is an international crime.
  • The theft of Iraqi art treasures is a crime!
  • Bush personally bears the legal responsibility for the deaths of US Soldiers in a war of naked aggression –a war crime! I urge family members of slain US soldiers bring a class action against George W. Bush personally. He is personally responsible for every military death in wars that are illegal under both US and International Conventions to which the US is signatory!
